We/ Gofreely, are an internet based mobile phone application by M/s Smiling Souls Services LLP, and this document uses the words “we” and “Gofreely” interchangeably, and “you” and “users” interchangeably. The expression “we” covers both and M/s Smiling Souls Services LLP, as and when the context allows.

Terms “We”, “Gofreely”, “M/s Smiling Souls Services LLP”, covers their respective current or former employees, officers, directors, agents, successors, assigns, parents, subsidiaries, divisions or affiliated corporations.

The users’ right to privacy is of paramount importance to Gofreely community. We take data security and privacy with critical importance. We obligate ourselves to maintain a no-leak and no-disclosure business as any private and sensitive data must receive proportioned protection. In our application, users and providers / ‘Healers’, are in control and can decide what they want to share and what they prefer to keep private.

• Any information you share with us by your own choosing is ‘redacted’, ‘obscure’, and ‘censored’ from everyone, including the employees of Gofreely, as well as the external ‘Healers’ we bring in, for your engagement.
• The information or data you share with our ‘Healers’ or otherwise, is for “your eyes only”. We only retain the basic minimum information like name, age, email ID, for the registration process.
• We do not send you messages without your permission.
• We send promotional messages with an option to opt-out at any time.
• We do not share data with any third party, whatsoever. However, Gofreely may, with your implied permission, use the basic information and data provided by you, to provide a more personalized online experience. Gofreely stores any data entered by the user, in a very secured format deterring any leakage or misuse.

No “sensitive personal data” is collected or stored and used as per the required legal guidelines. We emphasize and actively inform all users to avoid sharing any “sensitive personal data” with anyone related to, or connected to, or representing Gofreely.

The only purpose of collecting any basic or required information is to provide you with a more secure experience to the real-time users and enable the ‘Healers’ to address and engage the users, coherently and cogently.

In general, you can visit Gofreely’s portal without telling us who you are and without revealing any information about yourself. There are times, however, when Gofreely may need information from you. Only in such incidences, as disclosed, Gofreely reserves the right to gather the information and use it according to the terms mentioned.

Gofreely does not rent, sell, or share personal or any other form of information about you to anyone, including non-affiliates, except to provide the services as agreed or intended to be generally provided through the Gofreely application or any other service you've specifically requested, when Gofreely has your permission.

Gofreely provides your redacted and censored information to unspecified Healers (as defined in the disclaimer) who timely engage with Gofreely under strict confidentiality agreements and non-disclosure contracts.

However, Gofreely as per law, is legally bound to disclose information that any government organization with proper instructions from the court of law, in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or as otherwise required by law.

Gofreely, as far as its publishing and online involvement is concerned, is only an intermediary as defined under the “Information Technology Act, 2000” and “Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021”, and does not modify and edit or in any way manipulate user-generated contents (if any), and therefore, is protected under law.

Information collected directly:

Gofreely may, at times, receive or collect some information to operate, provide, improve, understand, support, and market our services, including when you install, access, or use our services. The types of information we receive and collect depend on how you use our services. When a user enquires about, registers for, or uses our services, websites or application, then the mechanics of the system may need to procure (off course with your consent) some basic identification data - including your name, address, e-mail address and phone number, preferences (e.g. education you are interested in) and service usernames and passwords.

Gofreely is a portal which brings two individual set of parties at the same platform. Though we cannot be held directly or vicariously liable by conduct or disclosure of either party (considering we do not ask for any personal or typical information to be disclosed by either party or monitor the information shared at our mobile application), we do go to extra lengths to ensure your rights are protected and privacy is maintained at all costs.

However, parties are bound to secure each other’s information in accordance with law and maintain each other’s privacy integrity, and ethics and are individually liable for any violations.

Other policy issues:

Parties are urged not to share sensitive personal information or core medical issues as Gofreely is not a medical facilitator or in any way certified to practice medicine or advice professionally. While under our privacy policy if such information are shared by any party, this would be to their own volition and such data shall be protected as far as reasonably possible by us, however, we can not take responsibility for any information which the user may have chosen to share on Gofreely mobile application on their own volition or otherwise.

Gofreely reserves the right to alter any of the conditions without prior notice to any of the parties. Gofreely stays committed to protecting the data of both parties.

Gofreely takes no responsibility and account for the consensual exchange of information between the real-time user and Healers (as defined in the disclaimer) and the post effect or events following with the sharing of the data between the parties.

Payments Data:

When you use our services for purchases or other financial transactions, we process additional information about you, including payment account and transaction information. Payment account and transaction information include information needed to complete the transaction (this includes information about the payment method, amounts involved). If you use our payments services, our privacy practices are described below: When any party registers to use services making or giving payments, we receive your bank's name and confirm the bank account for use. If you do not have a BHIM UPI PIN already for your bank account, you can set one using your partial debit card number, expiry date, PIN (if required by your bank), and bank-issued one-time password (OTP) to set up a BHIM UPI PIN.

We DO NOT RETAIN any user’s sensitive payment data (any debit card number, expiry date, PIN, OTP, or BHIM UPI PIN), as per law.

We don’t have access to the BHIM UPI PIN because it is encrypted by Common Library (CL) software provided by National Payments Corporation of India.
If you would like to manage, change, limit, or delete your payment information, we allow you to do that through your Payments settings or by deleting your account.

The extent of application services: Our services do not provide access to emergency services or emergency services providers, including the medical, police, fire departments, or hospitals, or otherwise connect to public safety answering points. You should ensure you can contact your relevant emergency services providers in your relevant city or local administration. Our services are limited to providing general non-certified advisory, discussions and guidance only.

YOU USE OUR SERVICES AT YOUR OWN RISK AND SUBJECT TO THE FOLLOWING DISCLAIMERS. Preserving user privacy is a top priority within the Gofreely community.

We regard data security and privacy with utmost importance. We are committed to upholding a policy of non-disclosure and non-leakage, ensuring the appropriate protection of private and sensitive data. Within our application, both users and service providers, referred to as "Healers," retain control over what information they choose to share and what they prefer to keep confidential.

• - Any information that you voluntarily share with us is treated as 'redacted,' 'obscured,' and 'censored.' This applies to everyone, including Gofreely employees and external "Healers" who may be engaged for your benefit.

• - Promotional messages are sent with an opt-out option available at all times.
• - We do not share data with any third parties under any circumstances.

However, Gofreely may utilize the basic information and data you provide, with your implied permission, to offer a more personalized online experience.

The data entered by users is securely stored by Gofreely to prevent any leakage or misuse. We adhere to required legal guidelines and refrain from collecting or storing "sensitive personal data." We actively inform and emphasize to all users the importance of avoiding the sharing of any "sensitive personal data" with anyone associated with Gofreely.

The sole purpose of collecting necessary information is to enhance the security of the real-time user experience and enable "Healers" to engage with users coherently and effectively.

In general, you can access Gofreely's portal anonymously without revealing your identity or personal information. However, there may be instances where Gofreely requires information from you. In such cases, as disclosed, Gofreely reserves the right to collect and use the information according to the specified terms.

Gofreely is committed to not renting, selling, or sharing any personal or other forms of information about you with anyone, including non-affiliated entities. Exceptions are made only for providing services as agreed upon or as specifically requested through the Gofreely application, with your explicit permission.

The "Healers" who receive your redacted and censored information are bound by strict confidentiality agreements and non-disclosure contracts.

However, according to legal requirements, Gofreely may be obligated to disclose information to government organizations under proper instructions from a court of law. This is done to investigate, prevent, or take action against illegal activities, suspected fraud, potential threats to individuals' safety, or as mandated by law.

Individual accountability is upheld for any violations.

We urge parties not to share sensitive personal information or critical medical details, as Gofreely is not certified to practice medicine or provide professional advice. If such information is shared, it is done voluntarily, and while we endeavor to protect it, we cannot assume responsibility for any data shared on the Gofreely mobile application. Gofreely reserves the right to modify any conditions outlined in this document without prior notice to any parties involved. Our commitment remains steadfast in safeguarding the data of both parties.

Gofreely disclaims responsibility for the consensual exchange of information between real-time users and "Healers," as well as any subsequent events or outcomes resulting from data sharing. Payments Data: When utilizing our services for financial transactions, additional information is processed, including payment account and transaction details. This information is necessary to complete transactions, and our privacy practices for payment services are detailed below: When registering for payment services, your bank's name and account confirmation are obtained. If you lack a BHIM UPI PIN, one can be set up using partial debit card details, expiry date, PIN (if required by your bank), and a bank-issued one-time password (OTP). Gofreely does not retain sensitive payment data such as debit card numbers, PINs, OTPs, or BHIM UPI PINs, in accordance with legal requirements.

The BHIM UPI PIN remains inaccessible to us as it's encrypted by the Common Library (CL) software from the National Payments Corporation of India.

You have the option to manage, modify, restrict, or delete your payment information through your Payments settings or by deleting your account.

The Extent of Application Services: Our services do not grant access to emergency services or providers, including medical, police, fire departments, or hospitals. For emergencies, contact relevant emergency service providers in your city or local administration. Our services are limited to offering general non-certified advice, discussions, and guidance.

BY USING OUR SERVICES, YOU RELEASE US, OUR SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, AND AGENTS FROM ANY CLAIMS OR DAMAGES ARISING FROM YOUR INTERACTIONS WITH THIRD PARTIES.

THE FOREGOING DISCLAIMER DOES NOT MODIFY YOUR RIGHTS WITH RESPECT TO THE PARTIES, UNLESS PROHIBITED BY APPLICABLE LAW IN YOUR COUNTRY OR TERRITORY OF RESIDENCE.

Indemnification:

Should users, "Healers," or any party on their behalf or a third party bring a claim (including a "Third-Party Claim") against Gofreely related to your actions or use of our services, you agree to indemnify and hold Gofreely, its employees, and directors harmless from any liabilities, damages, losses, and expenses, including legal fees and costs, connected to such claims to the fullest extent permitted by law.

Dispute Resolution and Governing Law: Disputes related to Gofreely will fall under the jurisdiction of the courts at 'New Delhi,' specifically the central district court.

Indian law serves as the governing law for any disputes involving Gofreely. Arbitration will be employed as a dispute resolution mechanism, with a sole arbitrator appointed mutually or through FICCI. The arbitrator may be a lawyer, a High Court judge, a retired District Judge, or a retired senior Bureaucrat with the Government of India.

Arbitrator fees shall not exceed the 'model fee' stipulated by the Arbitration and Conciliation Act, 1996, and proceedings will be conducted in English.

Terms of services :

Gofreely is an internet based application by Smiling Souls Services LLP and in the following content the words ‘we’ and ‘Gofreely’ are used synonymously, and the word ‘you’ and ‘users’ are likewise used synonymously. The term “we” covers both GOFREELY and Smiling Souls Services LLP in numerous contexts.

How we operate :

Gofreely makes you access it’s services in exchange of certain recurring fee as applicable ( in “Membership Services”). Your transactions and any other use of the Membership Services i.e. services you avail as soon as you enrol in Gofreely’s mobile application, are subject to these “Terms of Service”.

1- You understand that these terms apply to you from the very moment you DOWNLOAD the Gofreely application available on the concerned application store of your phone, or downloaded / used by any other medium.

2- You further understand these terms of service are to be read along with the privacy policy and each of these documents are incorporated in each other by reference.

3- These terms are legally binding and the application is governed by the laws of India and falls within the Lucknow administration.

Since the “user” choose to proceed with our application and enjoy it’s services, it is assumed that the users (engaging with other parties i.e. healers) have agreed to each and every ongoing term of usage, condition, and liability, and that these terms bind the user and Gofreely in accordance with the law, and that this document is to be read and applied as a whole.

We declare that you understand the following terms :

We refer to these individuals who assist you with your mental and emotional issues as ‘healers’ as a terminology.

To a certain extent, we do verify these individuals i.e. healers before associating with them. However, we do not hold accountability of each and every claim made by the healers and our selection procedure is quite transparent and rigorous to avoid any such potential problems.

Gofreely cannot be held liable, if any information declared by the healer may prove to not be accurate depiction of his or her representation.

You understand that these ‘healers’ are not our employees in any way, and are individuals associated with us for the limited purpose of assisting the users with their mental and emotional health issues, concerns and general feelings and thoughts about life ( sharing and interaction) and each of these healers are liable for their own behaviours, conducts, revelations or advices.

You understand that payments made by your registered accounts, would not be refunded in any circumstances without consultation with our team and that the sole way to get value of your recharged amount would be by using it to connect with healers on the application.

You understand that Gofreely is not certified to provide you with medical or psychological assistance in any way and is a platform to provide you with companionship to discuss your issues, concerns, inhibitions or general feelings with the ‘healers’ who have been in similar situations like yours and may now be in the position to lend an ear to you and support you with their presence and assist you in a non- professional way without being liable for their advices/ discussions. Gofreely highly urges you to seek professional help through government authorised institutions like hospitals, police stations, and so on if you are at any medical, psychological or physical risk.

You understand that Gofreely as an application keeps it’s users anonymous and still put you in touch with people who, as per their declarations, are experienced on those issues and are in the position to provide you with suitable guidance. If on the basis of what you choose to share with the fellow party, any issue/ dispute arises by yours or your healer’s acts, gofreely takes no accountability of it. We urge you to report such acts to our support team. You (as users) are liable to keep us well informed for any such circumstance, event, conflict or dispute that may arise on the basis of the conversation which you may get into with the healers.

You understand that you are responsible for your actions or decisions while using the application and Gofreely is not in any way liable for any illegal, self-destructive or otherwise violating actions. In such circumstances, we strictly distance ourselves from any association with any party as we are a platform for independent individuals for the purpose of interaction and cannot be held responsible for any unfortunate incident such as suicide, depression or mental instability of individuals.

Gofreely declares that the interaction between the real time users and healers is not any any manner a professional contract and doesn’t tender any professional advice.

Gofreely declares that no security towards any loss caused by any party, be it of any kind. Gofreely holds fully qualified consent from both parties for their interaction with each other. Gofreely reserves all the rights to change, modify, suspend or discontinue the Member Services with or without providing you immediate notices and will not be held liable for any discrepancies further.

In numerous cases, it may be possible that the content of our Member Services may become unavailable due certain restrictions from our licensors or other legal reasons and have holds no responsibility of any such unavailability.

CHANGES TO MEMBERSHIP SERVICES :

We may transform the terms of Membership Services on regular basis. Hence, we urge you to periodically review the most updated version. In case to deny to use the updated Membership Services then GoFreely reserves its right to discontinue your use of Membership Services.

Communications :

By using the Membership Services, you consent to receive official communications from us including marketing communications such as newsletters, special offers, promotional announcements and customer surveys to your registered email address.

ANTI- HACKING PROVISION :

You completely agree to not violate the Terms of Membership Services at Gofreely in any manner possible. You further agree to not indulge in the following :

1.Use of portal for motives which are prohibited by the law or regulations in any way or to facilitate violation of these laws.

2.Use any of our deep-links, computer codes, data mining, algorithms, methodology or manual processes to access, acquire or replicate any part of the portal without Gofreely’s written concurrence.

3.Obtain any information or data through any means from the platform, that has not been made publicly available by Gofreely.

4.To breach the security of application or attempt to gain unauthorized access to the data, confidential information or networks connected to any server associated with Gofreely via hacking passwords, mining data or any other means.

5.To intervene in the proper functioning of Gofreely application in any possible manner through my activities while using the app.

6.Recording of conversations by third party devices or with other possible means is conclusively considered as hacking as per the Membership policy.

We do not provide any refunds in case of recharge price reduction. You do agree to pay Membership Services that you have registered in (out of which, the free trial period is an exception)

For Global Community :

Gofreely would recharge your wallet amount considering the applicable taxes, bank fees and other aspects like currency fluctuations.

Other Terms :

You accept and agree that certain content available in the Member Services may be considered derogatory to some users and that such content may not be categorized as such. Moreover, certain features of Member Services are not assured to be precise and accurate. You ( as a user ) voluntarily accept to use Member Services at your own risk and are subjected to applicable laws.

Gofreely is not responsible for any content that you find offensive.

You consent that Gofreely isn’t answerable for any act or conduct of either of the individuals that originates from the discussion that takes place between user and healer. Similarly, the healer cannot be held liable for any wrongful conduct of the user, and the discussion ought not be taken as prompt to perform any illegal activity either from the healer or by team Gofreely.

Refund Policy :

Return and cancellation

Our Return and Refund Policy was last updated on 21 December, 2023. Thank you for using Gofreely. If for any reason you are not satisfied with a purchase, we invite you to review our policy on refunds and returns.

The following terms are applicable for any products that you’ve purchased from us.

Interpretation and Definitionss

Interpretation :

The words in which the initial letters are capitalised have the meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in the singular or in the plural.

The terms of use apply to your use of the website of Gofreely and Gofreely mobile application provided by Smiling Souls Services LLP. (hereafter ‘we’ or ‘us’ or ‘our’ or ‘Gofreely’. Please go through them carefully. If you object to anything in the terms of use or our privacy policy, please do not use the app or website or any other service we offer.

YOUR ORDER CANCELLATION RIGHTS :

Since Gofreely does not sell physical goods there is no cancellation or return. Gofreely users can make a payment to purchase digital goods which can be used for soliciting a connection with other Gofreely users. Digital goods include Messages and coins, diamonds etc. New digital goods may be introduced and older digital goods may be modified or removed from time to time. Digital goods obtained through referrals, will expire within 12 months.

When you make an in-app purchase, you will be prompted to enter details for your account with your Software Store (“your Gofreely Account”), and your IAP Account will be charged for the in-app purchase in accordance with the terms disclosed to you at the time of purchase as well as the general terms for in-app purchases that apply to your IAP Account. Some Software Stores may charge you a sales tax, depending on where you live.

If you purchase an auto-recurring periodic subscription through an in-app purchase, your IAP Account will continue to be billed for the subscription until you cancel. After your initial subscription commitment period, and again after any subsequent subscription period, your subscription will automatically continue for an additional equivalent period, at the price you agreed to when subscribing.

If you do not wish your subscription to renew automatically, or if you want to change or terminate your subscription, you will need to log in to your IAP account and follow instructions to cancel your subscription, even if you have otherwise deleted your account with us or if you have deleted the Gofreely application from your device. Deleting your account on Gofreely or deleting the Gofreely application from your device does not cancel your subscription; Gofreely will retain all funds charged to your IAP Account until you cancel your subscription through your Account.

In general, payments once made, are not refunded under any circumstances. In other words, you do not have the option of cancelling or getting a refund for any payment. It follows that you will not be getting a refund for any payment when your membership is terminated. We may make an exception if a refund is requested within 14 days of the transaction date if the payment was made in a currency other than INR, if the paid goods remain unused, and if the laws applicable in your jurisdiction provide for refunds. Such refunds will be issued within 7 business days.
